1 Scope of Application
These General Terms and Conditions (GTC) apply to all services provided by Linda Partl Congressorganisation (hereinafter referred to as the “Organizer”) in the field of event management and trade fairs in Austria. Deviating terms and conditions of the contractual partner (hereinafter “Customer”) shall not be recognized unless the Organizer expressly agrees to them in writing.
2 Conclusion of Contract
A contract is concluded upon written confirmation by the organizer. Offers are subject to change and non-binding. Additional agreements or amendments must be made in writing.
3 Services of the Organizer
The organizer offers comprehensive services for the planning, organization and implementation of events and trade fairs. The specific scope of services is set out in the respective offer/contract.
4 Obligations of the Customer
The customer shall provide all necessary information, permits and documents in good time. The customer shall ensure that no third-party rights are infringed and shall be responsible for compliance with statutory regulations.
5 Remuneration and Terms of Payment
The remuneration is based on the individual contract. Unless otherwise agreed, invoices must be paid within 14 days of the invoice date without deduction. In the event of late payment, statutory default interest shall be due.
6 Cancellation and Withdrawal
Cancellation by the customer must be made in writing. Unless otherwise agreed, the following cancellation fees apply:
Up to 6 months before the start of the event: 30% of the agreed fee
3-6 months before the start of the event: 50% of the agreed fee
Less than 3 months before the start of the event: 100% of the agreed fee
7 Liability
The organizer shall only be liable in cases of gross negligence or intent. Liability for loss of profit or consequential damage is excluded. The customer shall indemnify the organizer against claims by third parties, insofar as these are not based on gross negligence on the part of the organizer.
Linda Partl Congressorganisation accepts no liability for any personal injury or damage to property or exhibited goods. The exhibitor shall be liable for damage of any kind caused by him or his contractors.
8 Regulations for Exhibitors
Space is allocated by the organizer. There is no entitlement to a specific space.
The exhibitor is obliged to set up and clear his stand within the specified set-up and ismantling times.
The stand design must comply with the applicable safety regulations and technical guidelines.
Subletting or passing on the stand space to third parties requires the written consent of the organizer.
Exhibitors are responsible for insuring their own exhibits and company equipment.
Advertising outside the allocated stand is only permitted with the express permission of the organizer.
9 Regulations for Participants and their Registrations
Registration for an event must be made in writing or online and is binding.
The participation fee must be paid within the specified period, otherwise participation cannot be guaranteed.
Cancellation of registration must be made in writing. Unless otherwise agreed, the following cancellation fees apply:
o Up to 4 weeks before the start of the event: 50% of the participation fee
o Less than 4 weeks before the start of the event: 100% of the participation fee
The organizer reserves the right to exclude participants from the event for good cause.
In the event of non-attendance, there is no entitlement to a refund of the participation fee.
10 Force Majeure
If an event cannot be held due to force majeure (e.g. natural disasters, pandemics, official orders), there is no entitlement to compensation. Services already rendered shall be remunerated.
11 Data Protection
The organizer processes personal data in accordance with the applicable data protection regulations. Data will only be passed on to third parties if this is necessary for the fulfillment of the contract.
12 Place of Jurisdiction and Applicable Law
The law of the Republic of Austria shall apply. The place of jurisdiction for all disputes is the competent court at the registered office of the organizer - Innsbruck, Austria.
13 Final Provisions
Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose.
